Common Questions About Surrogacy in Oklahoma

Surrogacy can be an ideal way for couples and individuals who cannot conceive on their own to grow their families. By working with a surrogate who carries and delivers their baby, intended parents enter a rewarding and deeply collaborative arrangement. As a surrogacy-friendly state, Oklahoma is a great place to begin your surrogacy journey.

How do I become a surrogate in Oklahoma?

Gestational surrogacy involves a surrogate carrying a pregnancy for a couple or individual who cannot do so on their own, whether for medical or biological reasons. A gestational surrogate does not use her own eggs, so there is no genetic link between her and the baby. In addition to gaining a sense of deep fulfillment from helping others achieve their dreams, surrogates are also generously compensated for their commitment.

To ensure the safety and well-being of the surrogate as well as the baby, surrogacy requirements are strict. While specific requirements vary by agency, Fertility Source Companies maintain stringent requirements for all surrogates, including being between the ages of 21 and 43, being a U.S. citizen or having the legal right to work in the U.S., and having delivered one or more children whom you are currently raising. We also ensure all surrogates have a stable home and financial situation, do not smoke or use drugs, and have a BMI of 32 or less.

To become a surrogate in our program, you must complete several steps, including:

  • The initial application process
  • Medical records submission
  • Various physical and mental screenings to ensure readiness for surrogacy
  • A thorough background check

If you’re approved to move forward, you’ll be added to our surrogate pool, and from there, we’ll match you with intended parents. After a match is made, you’ll move to the next steps, which include:

  • A comprehensive physical exam at the intended parents’ chosen fertility clinic
  • A meeting with an attorney of your choice to review the intended parents’ drafted surrogacy contract and suggest any changes before signing
  • Taking a series of injectable fertility medications to prepare your body for pregnancy
  • Undergoing the embryo transfer
  • Getting a pregnancy test and an ultrasound
  • Regular appointments with your chosen obstetrician

By the end of the surrogacy process, you’ll have completed a truly remarkable journey to help intended parents build their families and achieve their dreams. Learn more about the surrogacy process.

Surrogate Pay and Compensation in Oklahoma

In Oklahoma, all first-time surrogates receive a base pay of $65,000. This is intended to reflect the significant commitment involved in the surrogacy process. Compensation is paid in eight installments after a fetal heartbeat is detected, confirming pregnancy. You’ll also receive allowances for miscellaneous costs related to the surrogacy, such as maternity clothes, travel to medical appointments, childcare, and more. How do I find a surrogate in Oklahoma?

How Surrogates Are Screened in Oklahoma

All surrogates in Oklahoma are thoroughly screened to ensure they’re physically and mentally prepared for the process. Medical exams, blood tests, personal and family medical history reviews, psychological evaluations, criminal background checks, partner screening, and other reviews are typically conducted by the agency you’re working with. At Fertility Source Companies, we take great care during the screening process to ensure the surrogate is healthy, has a stable living and financial situation, and is fully ready for the surrogacy journey.

Once surrogates have progressed through these screenings, they enter our pool of surrogates for you to choose from. We ask all intended parents about their family-building preferences and goals so we can help them find the ideal surrogate. Shared values, location, communication style, general personality and temperament, and willingness to adhere to certain lifestyle or religious restrictions may all be taken into account. You’ll review surrogate candidates’ profiles and have the opportunity to meet with them virtually or in person.

With this thorough, thoughtful approach, we can help ensure a happy, harmonious experience for everyone involved.

Surrogate Costs in Oklahoma

In Oklahoma, the cost of a surrogacy journey can vary depending on the individual circumstances of the intended parents and gestational carrier. At Fertility Source Companies, our agency fees are structured in installments throughout key stages of the journey, allowing intended parents to plan for costs as the process progresses.

Gestational carrier compensation is a significant part of the overall budget. Our current base compensation begins at $65,000 for a first-time gestational carrier and $75,000 for an experienced gestational carrier. Other expenses include a monthly allowance for surrogacy-related expenses such as childcare, maternity clothing, vitamins and supplements, wellness services, and more. What are the surrogacy laws in Oklahoma?

Oklahoma is generally considered a surrogacy-friendly state. As of 2019, gestational surrogacy is legal, and a framework is in place to enforce all legally binding surrogacy contracts. Married couples, whether heterosexual or LGBTQ+, can all pursue gestational surrogacy to build their families.

However, Oklahoma statutory law explicitly requires intended parents utilizing this framework to be married. Unmarried couples are excluded from the protections of the Gestational Agreement Act and cannot utilize this formal legal path.

Legal Highlights:

Oklahoma requires the surrogacy contract (Gestational Carrier Agreement) to be validated by a court before an embryo transfer can take place. This confirms the intended parents will be the legal parents. The actual pre-birth parentage order is typically issued later, during the second or third trimester of the pregnancy.

  • Surrogates must meet specific requirements, including being at least 21 years old, having previously given birth to at least one child, and passing comprehensive medical and psychological evaluations. Surrogates must also have been residing in Oklahoma for at least 90 days, unless the intended parents meet this requirement.
  • Both the surrogate (and her spouse, if married) and the intended parents must be represented by separate, independent Oklahoma-licensed attorneys.
  • Intended parents do not necessarily need a genetic link to the baby to get a pre-birth order. Married couples utilizing donor embryos can obtain a pre-birth parentage order as long as their surrogacy agreement was validated in court before the embryo transfer took place

While the intricacies of surrogacy law can be complex, the team at Fertility Source Companies has worked with intended parents of all backgrounds and situations. We’ll help facilitate all legal processes to ensure a smooth, seamless process.
